This policy statement sets out the manner in which Serverside Group and its affiliates ("Serverside") deal with its intellectual property rights ("IPR").
Innovative new technology is Serverside's life blood. Serverside invests large amounts of engineering and financial resources into developing its inventions. Given these investments, Serverside takes the resultant IPR very seriously.
Serverside's IPR provides significant market and technological advantages. The company is committed to preserving and enhancing its competitive position through strategic IPR portfolio management.
This portfolio management is under the leadership of Dr. Justin Hill, European Patent Attorney, at Ipulse. Dr. Hill has been recognized by Legal 500 and Chambers & Partners UK as one of a select number of leaders in the field of IP. He has extensive experience coordinating IPR strategy for innovative technology companies such as Serverside.
IP rights are critical to our technology offering
Serverside deals with all types of intellectual property. Significantly, Serverside controls a growing number of international patent rights relating for example to our innovations in:
Serverside's international patent rights include the following PCT families: PCT/GB04/000626; PCT/GB04/003537; PCT/GB05/003198; and PCT/GB05/003217, each of which is directed to a number of different inventions deemed core to our business operations. Serverside's card customization technologies are protected by various patents including US Patent 7,931,199, US Patent 7,946,490 and European Patent 1602072.
Serverside is also the owner of further IPR that protects its software, trading style, technologies and other valuable business assets including but not limited to trade mark rights, rights in passing off and unfair competition, trade secrets, database rights, design rights and copyrights.
Unauthorized use of Serverside's IPR damages not only Serverside and its partners but the industry as a whole. Serverside respects the IPR of others and expects others to respect its rights as well.
Serverside may from time to time consider entering into licensing arrangements. It should be understood, however, that (1) every situation is unique and may not warrant a license at all, or may warrant terms that differ from those offered with regard to other IPR, and (2) Serverside only grants licenses in writing. Under no circumstances shall licenses or other transactions involving Serverside be understood to convey any "implied" rights not specified in the formal terms and conditions.

In certain circumstances, Serverside's processes may involve the use of third party IPR, such as copyright in images applied to cards. It is Serverside's policy to respect third party IPR and not knowingly to infringe any such IPR. We believe we have taken appropriate steps to minimise the risk of infringing third party IPR. If a third party is aware of any of their IPR being used in an unauthorized manner in connection with Serverside's business, they are requested to contact Michael Campbell, in-house General Counsel for Serverside, who will investigate the situation and reserves the right unilaterally to suspend relevant activities.
